Northerm Windows are warranted against defects in material and workmanship with the following limitations:
Vinyl Extrusions
Capitol Glass
Northerm Windows warrants that, for a period of twenty (20) years from
the date of purchase, the EXTRUSIONS will not rust, rot, crack,
corrode, peel, blister or suffer non-uniform fading discoloration;
provided that non-uniform discoloration resulting from unequal exposure
of surfaces to the sun and elements is not covered by this warranty.
Hardware
Capitol Glass Northerm
Windows provides a lifetime warranty against defects in material and
workmanship in the hardware of a Northerm Window. This warranty does
not cover any product that has been been abused, misused, worn out, or
altered. Nor does it cover corrosion related damage if used in
corrosive environments.
Insulated Glass Unit
Capitol Glass Northerm Windows warrants the Insul-ThermTM
insulated glass unit for a period of ten (10) years from the date of
purchase against material obstruction of vision as a result of fogging
or film formation on the internal glass surface caused by failure of
the hermetic seal due to defects in material or workmanship. This
warranty does not cover Insul-ThermTM
insulated glass failures resulting from, or relating to: improper use,
handling or other abuse, failure to adhere to the Capitol Glass
Northerm Windows glazing instructions, or glass breakage. The use of Insul-ThermTM insulated glass units in structural and/or sloped glazing applications are not covered under this warranty.
Limitations
THIS WARRANTY IS
EXCLUSIVE, AND CAPITOL GLASS NORTHERM WINDOWS MAKES NO OTHER WARRANTY
OF ANY KIND WHATSOEVER, EXPRESSED OR IMPLIED, WITH RESPECT TO THE
PRODUCTS MANUFACTURED AND SOLD BY IT, WHETHER AS TO MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER. No agent,
employee or representative of Capitol Glass Northerm Windows has any
authority to bind Capitol Glass Northerm Windows to any affirmation,
representation or warranty concerning Capitol Glass Northerm Windows
products or parts, except as stated herein.
Remedy
If a Northerm Window is
found to be defective by Capitol Glass Northerm Windows, in its sole
judgement, Capitol Glass Northerm Windows will, at its option, either
repair or replace such defective product. THIS REMEDY SHALL BE THE
EXCLUSIVE REMEDY AVAILABLE FOR ANY DEFECTS IN THE NORTHERM WINDOWS
PRODUCT, INCLUDING WITHOUT LIMITATION, CAPITOL GLASS NORTHERM WINDOWS'
NEGLIGENCE. CAPITOL GLASS NORTHERM WINDOWS SHALL NOT IN ANY EVENT BE
LIABLE TO ANY BUYER FOR CONSEQUENTIAL OR INCIDENTAL OR PUNITIVE DAMAGES
OF ANY KIND, WHETHER FOR BREACH OF WARRANTY, NEGLIGENCE, ON THE BASIS
OF STRICT LIABILITY, OR FOR ANY OTHER REASON.
The purpose of this exclusive remedy shall be to
provide the buyer with repair and replacement of products manufactured
by Capitol Glass Northerm Windows found to be defective in materials or
workmanship or negligently manufactured. This exclusive remedy shall
not be deemed to have failed of its essential purpose so long as
Capitol Glass Northerm Windows is willing and able to repair or replace
said defective products or parts in the prescribed manner.
